7. Omnes Clerici domi et in Ecclesia vestem talarem de- 
ferent, decenter clausam per totam longitudinem. Foris 
vestiantur ut decet clericos et collare, quod romanum voca- 
tur, gerant. 

Stricte prokibentur clerici ne cauponas, &c, (saloons) in- 
grediantur nisi in itinere vel casu necessitatis. 

8. Ancilla sit eetatis maturioris et in domo parochiali ne 
habitent magistrae scholarum vel mulieres junioris aatatis. 

9. Quap sequuntur ex Synodo Richmondensi deprompta 
Clero Diceoesano in Domino commendamus et praBcipimus ; 
" Qui in variis Missionibus Rectores aut Assistentes auctori- 
tate Nostra constituuntur, omni studio in id intendant ut 
tanquam fratres habitent in unum et pro I>ei gloria anima-

tentes suos tanquam in Jesu Christi Sacerdotio comparticipes

10. Ecclesia sapienter mandat ut qui curam habent ani- 
marum inter oves sibi commissas resideant. "Nisi de Nos- 
tra licentia propria, ne cuivis liceat Pastori, Missam gregi illi 
commisso debitam, sua absentia omittere, diebus Dominicis 
aut Festivis de prsecepto, extra casum necessitatis gravem. 
quo ad Nos recurri nequit."— (Syn. 1861). Prohibemus ne 
Assistens per totam diem, multo minus ad intempestivam 
noctis horam a domo pastorali absit, nisi cum consensu Eec- 
toris vel ob causam urgentem curse animarum. 

11. Prohibentur Sacerdotes omnes (conc. P. B. III, No. 82) 
ne quaestuosas suo nomine vel sub alieni nominis involucro 
negotiationesexerceant ; ne pro aliis flde jubeant ; ne aliorum 
in negotiis prpcuratores, inconsulto Episcopo, flant; ne 
cujusvis curam ac tutelam, praeterquam suorum, nisi Epis- 
copo consentiente, susci piant. 

12. Sacerdotibus prsecipimus ut neminem unquam e sug- 
gestu vel ex altaris loco notent. Ab increpationibus omnino 
abstinentes vitia insectentur ; sed numquam dentoccasionem 
suspicandi se personas non peccata oppugnare. 

13. Sacerdos sive ssecularis sive regularis, qui hanc Dioece- 
sim, quavis de causa reliquit, eo ipso privatus manet faculta- 
tibus in eadem illi concessis, quamvis postea redeat, donec 
eaedem a Nobis denuo fuerint obtentse. 

14 Libertatis conscientife gratia, concedimus ut omnis 
Sacerdos extraneus qui in propria dioecesi facultatibus ordi- 
nariis praeditus cognoscitur, valeat absolvere Sacerdotem 
Nostras Dioecesis qui in hac ei confiteri elegerit, ac pariter 
omnes personas quae in domo ejus veram habent habitatio- 
nem ; pro his casibus facultates ordinarias confessario con- 
cedimus. 

DE SACRAMENTIS. 

15. Siquidem sancta sancte tractanda sunt, sedulo mission- 
arios monemus de obligatione ritus ac cferemonias bene ad- 
discendi ut idonea Sacramentorum administratio efflciatur.

Ad hunc flnem assequendum, illos seepe ac attente legere 
oportet "Rubricas generales Eitualis Komani," quas, in 
quantum possibile est, servare tenentur. 

16. Parochus vel quivis alius sacerdos ad quem Sacramen- 
torum administratio pertinet, meminisse in primis debet, 
se sancta tractare atque omni temporis momento, ad tam 
sanetee administrationis officium paratum esse oportere. 

Quacumque diei ac noctis hora ad Sacramenta minis- 
tranda vocabitur, nullum officio suo preestando, preesertim sl 
necessitas urgeat, moram interponat. (Kit. Rom.) 

17. In omni Sacramentorum administratione superpelliceo 
sit indutus (Sacerdos), et desuper stola ejus coloris, quem Sa- 
cramenti ritus exposcit, nisi in Sacramento Pcenitentiee oc _ 
casio vel consuetudo aliter suadeat. (Kit. Rom.) 

18. Caveant Sacerdotes semper et preesertim in Sacramen- 
torum administratione ut ab omni, vel levissima, Simoniee 
vel avaritiee suspicione longissime distent ; caveant ne quid, 
occasione Sacramenti administrandi vel administrati, directe 
vel indirecte exigant aut petant ; sed gregi suo paoperi, Jesu 
pauperis amore, gaudeant se pauperes divinee gratiee- largita- 
tem profundere. 

19. In admimstratione Sacramentorum curabit (Sacerdos) 
ut sacra suppellex, vestes, ornamenta, linteatnina et vasa 
ministerii integra, nitidaque sint et munda. (Rit. Rom.) 

20. Olea Sacra asservanda sunt in vasculis argenteis aut 
saltem stanneis bene obturatis ; quee vascula in loco proprio y 
honesto ac mundo, sub clave, ac tuta custodia asserventur.

DE BAPTISMO. 

22. Baptismus cum sit ad salutem necessarius summo zelc?

procuranduin est ut parentes quam primum infantes suos ad 
fontem baptismalem offerant ne ullus sine Baptismo decedat. 

23. Cum "proprius Baptismi administrandi locus sit Ec-> 
clesia " prohibemus ne istud Sacramentum, extra casum ne- 
cessitatis in sedibus privatis dehinc conferatur. Distantia 
locorum, viarum impedimenta, intempestas aeris, incuria 
parentum et tutorum qui minime se exhibeant sollicitos de 
sorte filiorum aut pupillorum aeterna— hac omnia casum ne- 
cessitatis constituunt. His in adjunctis Baptismus est priva-> 
tim conferendus, ac ceremonise alio tempore in Ecclesia sup- 
plendae. Attamen, si sapienter prseVideatur fore ut baptiz- 
andus in posterum ad Ecclesiam sine gravi incommodo 
asportari nequeat, sacramentum conferre solemniter liceatd 
Hac de re missionariorum conscientiis onus imponimus. 

21. In memoria habeant Sacerdotes Baptismum ab acatho- 
licis collatum summe in dubium esse vocatum. Proinde e 
sectis neo-conversi fere sunt semper sub conditione baptiz- 
andi. In Baptismo ad fidem conversis conferendo istam 
jubemus formulam Professionis Fidei adhibendam, nuper 
Bomee editam. 

25. Quacunque consuetudine in contrarium non obstante s 
stricte prohibemus ne pastores et parentes acatholicos ad- 
mittant sponsores. Bationes palam se monstrant, 

26. Quae de Baptismate Neo-Conversorum edixit Conc. P. 
B. III, Titulus IV, Cap. I, curent omnes ut addiscant et se- 
quantur. 

27. Mandamus ut quae in Bituali Komano de aqua baptis- 
mali, de patrinis et de nominibus imponendis praeseribuntur 
ab omnibus religiosissime serventur. 

28. Curet Pastor ut omnes, praesertim uxores, sponsae efc 
obstetrices modum baptizandi calleant et ut Sacramentum in- 
fantibus in periculo mortis administrent. 

29. Quando in domibus privatis confertur Baptismus cu-

gatur fons baptismalis et sub clavi custodiatur. 

31. In baptismo adultorum licet uti formula quse in Rit. 
Bomano pro baptismo infantum prsescripta est, ad quin- 
quennium a die 30a Januarii, 1887. 

DE CONFIRMATIONE. 

32. Oportet animarum Pastores de conflrmatione gregem 
sibi commissum diligenter docere ita ut et adulti qui hoc 
salutare Sacramentum quacunque ex causa nondum suscepe- 
rint, ad illud digne suscipiendum tandem alliciantur et 
parentes quam maximam dent operam ut liberi ad idem 
sacramentum scienter ac pie accedant. 

33. Rectoris est sive per se sive per Assistentem Sacerdo- 
tem omnes pueros aliosque confirtnationem suscepturos sum- 
ma diligentia instruere et praeparare 

34. Confirmandi habeant patrinos, juxta Eubricas Ponti- 
flcalis ; quod si aliquando contingat non posse sine magno in- 
commodo singulis candidatis singulos provideri sponsores, 
duo saitem pueris et duse puellis dentur, iique edoceantur 
omnia qu£© ad eorum munus spectant. 

35. Ad moram aliaque incommoda in hujus Sacramenti 
administratione evitanda, ConfiLrmandos judemus tesseram 
habere nomina sua complectentem et a Pastore signatam ; 
et haec tessera occasione Confirmationis est exhibenda. Hoc 
Sacramentum accepturos decenter ac modeste esse indutos 
oportet. 

DE EUCHARISTIA. 

36 Monemus Sacerdotes omnes et vehementer in Domino 
hortamur ut Sanctissimum Eucharistiae Sacramentum debito 
cultu prosequantur. Non tantum stricte sed et generose ser- 
ventur quee in Rubricis prasscribuntur de tabernaculi pul-

chritudine, de linteaminum munditia, et de lampade oleo 
olivarum vel saltem oleo vegetabili nutritoetsemperardente, 
Caveant ne clavis tabernaculi in Altari aut in alio loco 
patenti relinquatur, sed semper in loco tuto reponatur. 

37. Eenovatio SS. Speciei fieri debet semel in hebdomada 
sive in Ecclesiis sive in communitatum oratoriis. 

38. Sedulo vitetur usus tot habendi corporalia in usu 
quot sunt vestimentorum bursse, unicum tantum corporale, 
quolibet tempore, in usu sit in bursa speoiali post missam 
reponendum et loco honoriflco servandum. 

39.— Summa diligentia opus est ut vinum de vite habeatur 
pro Sacriflcio Missse. 

40. In ecclesia unaquaque statuatur tempus quo Missa 
eelebretur et illud accurate servetur. 

41. Vetat Conc. Trid. ne cui Sacerdoti vago et ignoto 
liceat Missam celebrare ; idcirco, monemus Sacerdotes omnes 
ne in Ecclesiis sibi commissis siaant aliquem ignotum Sacerd- 
otem Sacra Munera obire, sine speciali Nostra Venia, si 
copia sit Nos adeundi, qua deflciente, permittimus ut Missam 
celebret per unam hebdomadam extraneus Sacerdos, sui 
Ordinarii litteris rite munitus aut si litteras non habeat qui 
bene notus sit Parocho aut ejus Vicario. 

42. Legem qua duee saltem candelse, ex cera compositse, 
accendendas sunt in Sacriflcio Missee et sex in Expositione 
SS. Sacramenti vim obtinere plenam in hac dicecesi declara- 
mus, saltem in unaquaque ecclesia prope quam residet Pastor. 

43. Notum est omnibus multum conferread omnem reliquse 
vitse rationem atque adeo ad aeternam cujusque salutem qua 
animi prseparatione.prima vice SS. Eucharistise Sacramen- 
tum sumpserit, quare Sacerdotes omnes in Domino hortamur 
ut in preeparandis juvenibus pro prima communione omnem 
diligentiam adhibeant. 

44. Indulgemus ut Benedictio S. Sti. detur tum in Ecclesiis 
tum in Oratoriis Communitatum dummodo cultu debito fieri 
possit.

45. Jubemus omnes Sacerdotes qui ad Altare accedunt ad 
Hostiam SS. e tabernaculo extrahendam omnino debere esse 
indutos superpelliceo et stola et habere duos cereos accensos, 
tamenadmittimuspraxim (0'K.,Ho. 201) extrahendi pyxidem 
parvam e tabernaculo jam prius pro viatico paratam ita ut 
ciborium visui exponi non debeat, sine superpelliceo et stola* 

DE PCENITENTIA. 

46. Paratissimum se prsebeat Sacerdos ad Confessiones 
audiendas, horis regulariter statutis, et fideliter servatis. 

47. Districte prohibemus ne a quovis Sacerdote ullo modo 
minnatur libertas fidelibus a Christo et ab Ecclesia concessa 
cuicumque voluerint Confessario approbato confitendi. 

48. In omni Ecclesia erigatur Confessionale extra quod 
non audiantur Confessiones mulierum aut puellarum nisi 
sint surdae. In domibus privatis audiantur mulieres in 
quantum potest per crates et semper in loco patenti.

49. Quater aut saltem bis in anno audiantur Confessiones 
puerorum et puellarum qui septimum annum jam attigerint 
et Sacrse Synaxi nondum sunt apti. 

50. Sedulo Pastores foveant etiam in junioribus consue- 
tudinem menstruae confessionis ut legi quam primum per 
omnem vitam conforment. 

51. Casus reservati. 
Confessarius absolvere nequit : 

a) Ab heeresi et apostasia a ride et a schismate eos qui, in 
loco ubi Sanctum Officium exercetur, v. g. Bomse, deli- 
querint. 

b) Complicem proprium in quolibet peccato mortali externo 
contra castitatem. 

c) Sacerdotem qui complicem proprium in hujusmodi pec- 
cato absolvere attentaverit. 

d) Personam cujuscumque sexus quse vel per seipsam falso 
denuntiaverit sacerdotem de sollicitatione in confessione, 
vel sceleste procuravit ut hoc ab aliis fieret. 

e) Personam sollicitatam, nisi prius sollicitantem Ordinario 
denuntiaverit, aut saltem se cum primum poterit deiatu- 
ram spondeat ac promittat. (Ben. XIV. Const. Sacr.) 

f) Catholicum qui novum Matrimonium conjuge superstite 
contrahere attentaverit. C. P. B. III. No. 124. 

g) Catholicum qui coram prsecone hreretico Matrimonium

52. Pro absolutione eorum qui coram prsecone haeretico 
Matrimonium attentaverunt et exinde excommunicationem 
contraxerunt, volumus ut absolutio extra confessionale de- 
tur, et ut adhibeatur Formula extans in Bituali Bomano, 
quod si hujus copia non sit, adhibeatur Formula pro abjura- 
tione et professione Fidei ; incipiens a " Kyrie Eleison " quae 
est fere ejusdem tenoris quseque prostat in Bitualis Compen- 
dio. In missionibus ubi non residet Sacerdos, et quando 
mora necessaria ad petendam facultatem magnum afferat in*

commodum, potest Missionarius ab hac censura absolvere, 
etiam in Confessione, injuncta gravi poenitentia. In hoc 
casu Sacerdos, de absolutione data, Ordinarium quam primum 
certiorem facere tenetur et rationes assignare ob quas id 
necesse esse judicaverit. 

DE EXTREMA UNCTIONE. 

53. Sacerdotes opportune visitare debent infirmos eosque 
hortari ut Sacramentum Extremse Unctionis suscipiant dum 
pleno rationis usu gandentut sic uberiorem fructum percipere 
possint. 

54. Nunquam licet ultima Sacramenta denegare mori- 
bundo sub prsetextu quod, avaritia ductus, nihil unquam ipse 
contulerit in usum Ecclesioe vel Pastoris. 

55. Volumus ut pueri septennio majores de hoc Sacra- 
mento instruantur et ipso muniantur. 

56. Juxta prsescriptum et mentem "Eitualis Komani" 
sedulus sit Pastor animarum in visitandis infirmis et agoni- 
zantibus etiam postquam ultima receperunt Sacramenta ; et 
illos exhortetur, conso^etur et elicito ab iis, si possint, novo 
confessionis et contritionis actu, nova identidem donet 
absolutione. 

DE MATRIMONIO. 

57. Cum Matrimonium magnum sit Sacramentum in 
Christo et in Ecclesia oportet ut illud sponsi debitis cum dis- 
positionibus recipiant. 

58. Semel in anno, tempore scilicet Quadragesimse fiat 
sermo de hoc Sacramento, et speciatim de mixtis connubiis. 

59. Curet Eector, quantum potest, ut Matrimonia mane 
intra Missarum solemnia celebrentur. 

60. Vetat lex ne Matrimonia mixta in Ecclesia celebrentur. 

61. Proclamationes bannorum tribus Dominicis vel diebus

f estis de praecepto faciendse sunt in ecclesia utriusque sponsi 
antequam nuptise contrahantur. Publicatio bannorum fleri 
potest quolibet anni tempore. Indulgemus ad tempus ut 
quilibet Eector possit ab una proclamatione dispensare, data 
causa sufficiente. 

In duabus aliis proclamationibus nunquamdispensabimus, 
nisi ob sufficientes et canonicas rationes, easque in scriptis a

62. In locis ubi Missa non celebratur singulis Dominicis 
possint Missionarii a duabus bannorum et ubi nulla est 
Ecclesia a tribus proclamationibua dispensare, onerata eorum 
conscientia de rationis sufficientia et de certitudine quod 
sponsi sint liberi in unoquoque casu. 

63. Dispensationes in scriptis semper petantur nisi gravis- 
sima urgeat necessitas. 

64. Eationes Canonicse (ut in Append. G. P. B. III, p. 249) 
ob quas dispensationem concedere expedit, clare sunt expri- 
mendee ; hoc enim generali Ecclesise lege pr&scribitur. 

Cum litteris supplicationis pro dispensatione ab una ex 
duabus proclamationibus tria scutata ; a tribus publicationi- 
bus quinque scutata mittantur, remittenda si non conce- 
datur dispensatio. Si quandoque contracturi sint pauperes, 
hoc tanquam sibi notum exponere Sacerdotis erit. 

65. In Matrimoniis mixtis clare dicendum est in petitione 
qusenam sit pars catholica et quee acatholica et caute et pru- 
denter inquirendum est de impedimentis— dispar. cult. liga- 
minis, &c.

Rev. and Dear Father : 

The decrees of the Third Plenary Council of Baltimore, 

having been examined by the Holy See and promulgated by 

the Apostolic Delegate, are to be observed as laws binding 

in conscience by all the Priests exercising the sacred ministry 

in this diocese. The Rev. Clergy should procure copies of 

the decrees and study them conscientiously, so as to become 

familiar with the letter and the spirit of these wise regula- 

tions. Some of the decrees call for the Immediate attention 

of Priests having charge of missions or parishes, viz: 

1.— Priests are forbldden to serve as guardians, executors or 
sureties, for any person or estate. (No. 82.) 

2. — It is forbidden to enter suit against any person for the 
collection of a church debt without havingfirst obtained 
the permission of the Ordinary. (No. 84.) 

3.— Pastors are admonished to frequentiy instruct the faith- 
ful on the dangers of mixed marriages. (No. 133.) 

4.— Pastors are bound to establish parish schools and to 
labor zealously for their Improvement; to visit these 
schools every week and to instruct the children in 
catechism and sacred history. (No. 201.) 

5.— At every mass, on Sundavs and holy-days of obligation, 
the Gospel is to be read and a short instruction, of nofc 
less than five minutes, given. (No. 216.) 

8,— Pastors are required to make an inventory of all church 
property, whether held for church, house, school or 
cemetefy purposes. A copy of the inventory is to be 
sent to the Ordinary and another preserved in the 
archives of the mission. (No. 276.) In this diocese the 
Rev. Pastors are requested to forward the inventory to 
the Bishop on or before July lst ; the copy kept by the 
Pastor, and the parish registers, will be shown to the 
Bishop when on his visitation. 

7.— Bishops are commanded to exact from every priest in 
charge of a church an annual statement of the financial 
condition of his mission. This statement is to be made 
known to the congregation and a certified copy sent to 
the Ordinary in the month of January of each year.

8,— Priests are not allowed to incur any church debt, or to 
make improvements or alterations in church, house, 
school or cemetery, without the written permission of 
the Bishop. (No. 279.) 

9. — Fairs, pic-nics, excursions, balls, &c, are forbidden, 
except with the permission of the Ordinary, who is not 
allowed to permft the sale or use of intoxicating liquors, 
wine or beer, at any such entertainment. (No. 290.) 
10,— It is forbidden to refuse absolution to Catholics who fail 
to pay church dues. (No. 292.) 

I take this occasion to exhort the Rev. Clergy to do all that 
they can, to dissuade their people from seeking dispensations 
from the banns, and from the impediments, "mixtae 
religionis" and " disparitatis cultus." The number of dis- 
pensations asked from the banns and for "mixed marriages" 
is appalling. Earnest and frequent instruction on these 
subjects ought to effect some chaDge for the better. 

In applying for dispensations, write and state the nature 
of the impediment or impediments and the reasons for 
granting the dispensation. Except in urgent cases, the 
application should be sent through the mail, marked on the 
outside, Official. In urgent eases, the telegraph may be 
used. 

Persons intending to marry should be instructed to give 
timely notice to the Priest that he may have sufficient time 
to obtain the necessary dispensations. 

In mixed marriages, it is my wish that the agreement pre- 
pared by the Iate Bishop Manucy should be signed by the 
eontracting parties before application is made for the dis- 
pensation. 

This circular being chiefly for the information of the Rev„ 
Glergy, need not be read in church.

The third Plenary Council, (Decree 126) forbids Catholics, 
under pain of grievous sin, to apply to the civil courts even 
for a divorce from bed and board, without having consulted 
the proper Church authority. 

When the marriage is valid, a Catholic, if permitted to ask 
for a civil divorce, should apply only for a divorce from bed 
and board.

ING MABKIAGE. 

1. A man under the age of seventeen, and a woman under 
the age of fourteen years, are incapable of contracting mar- 
riage — [Sec. 2309, Marriage voidable merely.] 

2. Minors— i. e. males under 21 years of age and females 
under 18, are not granted a marriage license, (and conse- 
quently are not allowed to marry) without the consent of 
their parents or guardians.— [Sec. 2315.] 

3. No marriage shall be solemnized without a license, to 
be issued by the Judge of Probate of the county in which the 
woman resides; which llcense is an authority to any one 
qualified to solemnize marriage, to join together in matri- 
mony the persons therein named — [Sec. 2314.] 

4. All persons solemnizing marriage in virtue of a license 

must, within one month thereafter, certify the 

fact in writing to the Judge of Frobate.— [Sec. 2317.] 

5. Any minister of the Gospel, who joins persons in mar- 
riage without a license, as required by this article, or who 
goes out of the State and marries persons, one or both of 
whom reside in this State, without such license, or a license 
from the State in which the marriage is celebrated, forfeits 
one thousand dollars, one-half to the use of the State, and 
the other half to the use of any person who may sue for the 
same.— [Sec. 2320.] „ 

6. Any minister of the Gospel, who knowingly solemnizes 
marriage between a white person and a negro or the descend- 
ant of any negro to the third generation, inclusive, though 
one ancestor of each generation was a white person, is liable 
to a fine of not less than $100 nor more than $1,000, and to 
six months imprisonment or hard labor.— [Crim. Code, Secs.

7. Upon granting a divorce, the court may give the 
custody and oducation of the children of the marriage to

either father or mother, as may seem right and proper* 
having regard to the moral character and prudence of the 
parents, tiie age and sex of the children ; and pending the 
suit may make such orders in respect to the custody of the 
children as their safety and well-being may require. But in 
cases of abandonment of the husband by the wife, he shall 
have the custody of the children after they are seven years 
old, if he is a suitable person to have such charge.— j

8. The Ohancellor may decree a divorce from bed and 
board for cruelty in either of the parties, or for any cause 
which would justify a decree from the bonds of matrimony, 
if the party applying therefor desires only a divorce from bed

MARBIAOE LAWS OF FLOEIDA. 

1. Twenty-one years is the age at which persons may 
marry without the consent of parents or guardians. 

2. A marriage license from the county judge is required.

only what may be conducive to the good order of the diocese, 
the salvation of souls and the honor of the Holy Church,

You are respectfully invited to send me before the lOth 
prox., suggestions on the practical matters which in your 
judgment call for diocesan legislation. 

The address and offerings forwarded to the Hoiy Father on 
the ocoasion of his sacerdotal jubilee were presented to his 
Holiness on January 21st, by the Bt. Eev. Mgr. 0'Connell, 
Eector of the American College, Eome. Mgr. 0'Connell, in a 
letter of January 24th, says : " His Holiness expressed much 
gratification, and commanded me to write you a very kind 
letter of thanks and to send his apostolic blessing for your- 
self, your Clergy and your flock." It may be wellto mention 
to your good people that their jubilee gifts were handed to 
the Holy Father and that he has sent them his grateful 
thanks and apostolic blessing. The offerings from the 
diocese amounted to six hundred dollars.
